These are the terms for the use (“Terms of Use”) of the website owned and operated by Star Underwriting Agents Limited trading as Star Insurance Specialists ("Star") and accessed under the domain name ‘starinsure.co.nz', 'starinsurance.co.nz', 'sual.co.nz', 'starauctions.co.nz', 'campercare.co.nz' (“the Site”). In these Terms of Use “we”, “our” and “us” refer to Star Underwriting Agents Limited.

By accessing or using this Site you acknowledge and agree to comply with these Terms of Use. If, after having read these Terms of Use you do not accept them, you should immediately log out from this Site.

We reserve the right to vary these Terms of Use and our Privacy Policy at any time by publishing varied provisions on this Site. By continuing to use this Site after the publication of any amended Terms of Use you are agreeing to be bound by such amended Terms of Use.

These Terms of Use should be read in conjunction with our Privacy Policy.

Intellectual Property

We either own or licence all copyright on this Site and all rights are reserved. We either own the intellectual property rights in the content material that appears on this Site, or we have obtained the permission of the owner of the intellectual property to use the content on this Site.

We grant you a non-exclusive, non-transferable licence to temporarily store one or more of our pages for the purposes of viewing the Site on your personal computer or device and to print one copy of the material solely for your internal use provided that you do not modify the Site content in any way and that you retain all copyright and other proprietary notices on the Site content.  We may revoke this licence at any time.

You should not rely on the information contained in this Site as personal advice. You are solely responsible for the actions that you may take in reliance on the information contained on, or accessed through this Site. You must not use this Site for any unlawful purpose or in a way that breaches any third party rights.  You must not distribute or upload any virus, corrupted files, or any malicious software that may damage the operation of the Site or any of our computer hardware or software.

Except as expressly stated in these Terms of Use, all warranties, representations or conditions relating to any aspect of this Site, or to the information contained on this Site (whether express or implied and whether arising in contract, at common law or under statute) are expressly excluded to the maximum extent permitted by law.

If any relevant statute (including without limitation the Fair Trading Act 1986 and the Consumer Guarantees Act 1993) implies statutory rights, conditions or warranties which cannot be lawfully excluded, our liability and the liability of our employees, directors or agents will be limited to, at our discretion, the supply of product again or the payment of the cost of having the product supplied again.

3. This Site is, to the extent permitted by law, provided "as is, where is, and as available", without any warranty of any kind including, without limitation, any warranty with respect to the quality, performance or functionality of this Site and that this Site will be interrupted or error-free. 

4. Changes or updates to the content of this Site may occur without notice. Neither we, nor our directors, employees or agents can accept liability for any errors or omissions and make no representations as to the accuracy, adequacy or completeness of any information contained on this Site.

5. To the extent permitted by law, Star and its directors and employees shall not be liable to you for any incidental, indirect, special, consequential or economic loss or damage (including, without limitation, loss of profits, loss of business opportunities or data, and exemplary, or punitive damages), liabilities, claims, or expenses whatsoever, arising out of, or in relation to, your use of, or reliance on information contained on or accessed through this Site, or your inability to use this Site, or in respect of any failure or omission by us to comply with our obligations under these Terms of Use, whether arising in contract, in tort including negligence, at common law or under statute.  

6. We shall not be responsible for any loss, corruption of your computer system, or interception of data sent to or from the Site that occurs outside of the Site and our computer systems (such as those which occur while data is being transmitted over the internet).

7. To the extent permitted by law, you indemnify us from and against all actions, claims, suits, demands, liabilities, losses, costs (including legal costs on a solicitor-client basis) or expenses arising out of or in any way whatsoever connected to the use of the Site.

As a convenience to you, this Site may contain links to other websites independently maintained by others. Because we do not control these other websites, we cannot be responsible for the content or accuracy of the information or other material on these linked websites.

Cookies

We use cookies when you are using this Site.  Cookies are small pieces of information that can be stored on your computer hard drive or temporarily in your memory.  Cookies allow us to track and target the interests of Site users.  The cookies that we send to your computer cannot read your hard drive or command your computer to undertake any action.  Any information we collect and share with third parties through cookies is aggregated and therefore anonymous (it does not include personal information which is likely to identify you).  The information we collect from cookies and other digital tracking tools may be used to provide you with personalised features, for security purposes, to monitor traffic on the Site, and to help us identify you.  This helps us to be able to deliver advertisements to you for our products that we think may be of interest to you, both on the Site and on third party websites, and to enhance your experience using the Site.  You may disable new cookies being installed and delete existing cookies from your computer using your website browser at any time.  However, if you do so, you may not be able to use all of the functions on our Site.

Jurisdiction

This Site provides information about insurance and the insurance products we provide for New Zealand residents only. Unless expressly stated otherwise, the Site, these Terms of Use and any disputes arising from their use, is governed exclusively by the laws and the courts of New Zealand, and you hereby submit to the exclusive jurisdiction of such courts.

To the maximum extent provided by law, we will not be liable for the failure of this Site to comply with the law of any other country.

Currency

All prices quoted on this Site including on the Pay Account and Quote pages are in New Zealand dollars (NZD). Any payment made through the Site payment pages will be charged to the processed credit card in New Zealand dollars (NZD).

Credit Card Payments

Payments made by credit card using our Site Pay Account, Buy Quote, Pay Auction ‘payment pages’ payments are processed by our payment gateway provider, Windcave New Zealand Limited (“Windcave”). All credit card data is entered directly between You and Windcave. 

No credit card information is handled, stored or processed by the Site. 

Where you choose to Buy Now a monthly insurance policy and where the first payment is made by you by credit card using the Buy Quote payment page, the first payment will be processed by Windcave. Windcave will concurrently tokenize* your credit card data and provide this token to Us. 

Your insurance policy will renew on the frequency shown in your documentation. We will automatically process further monthly insurance payments when they fall due using this token. Every 12 months we will provide you with a new insurance schedule. Please ensure there are sufficient funds available for each payment to be completed on the date shown below to ensure your insurance remains valid. If you have any changes to your policy that may affect the schedule of payments, please advise us no later than 3 working days before your next monthly premium is due. *Tokenized Data means data for which Windcave has substituted a sensitive data element with a non-sensitive equivalent that has no extrinsic or exploitable meaning or value.

General

These Terms of Use constitute the entire agreement between you and Star and supersede all prior inconsistent terms or statements.  

If any part of these Terms of Use is held to be unenforceable for any reason, the unenforceable part is to be modified and given effect to the greatest extent possible. If modification is not possible, the part or provision shall be severed from these Terms of Use. The remainder of these Terms of Use shall be binding on you.

A delay or failure to exercise any of our rights or remedies under these Terms of Use shall not constitute a waiver of our rights or prevent any further exercise of those rights. 

No waiver of any of our rights under these Terms of Use shall be effective unless it is provided by us in writing.
